The Equal Protection Clause of the Fourteenth Amendment, which states in part that “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws,” protects us from any type of discriminatory law.

Discrimination by the Government

As outlined in the Fourteenth Amendment, no state may make laws that deprive anyone of “equal protection of the laws” as described in the United States Constitution. Additionally, in conjunction with the Fifth Amendment, the Fourteenth Amendment guarantees equal treatment by the government.

This means that the government may not discriminate against individuals when they are applying to government-sponsored programs, or in hiring and employment practices. Any singling out and discrimination due to race, religion, gender, alienage, ethnicity or any other such classification is a violation of civil rights.
