Esmail v. Macraneh

In the case of Esmail v. Macrane, 53 F.3d 176 (7th Cir.1995), the court observed that equal protection also applied to non-suspect classes. Esmail charged that a public official, the mayor of Naperville, Illinois, had targeted him. Esmail, who owned a liquor store, had been denied a liquor license numerous times. The plaintiff observed that the denials were based on fabricated or petty reasons and were designed to target him in a vindictive manner. It was noted that there was a campaign created against the liquor store owner that was fueled by malice.

The court found in Esmail’s favor and noted that the liquor store owner and his situation did fall under equal protection of the laws. This concept is found in the Equal Protection Clause of the Fourteenth Amendment. Esmail, as a part of a non-suspect class, was protected against such actions and the behavior of the government. In essence, the court ruled that individuals have equal protection against misconduct and disparate treatment by a government official even if they are not a part of one of the suspect classes.
