Everyone in the United States has a right to due process if they are arrested. Due process involves many things, including the right to a fair and speedy trial. In essence, due process, which is found in the Fifth and Fourteenth Amendments to the United States Constitution, acknowledges that anyone who is arrested, charged with a crime, and goes to trial will be given a fair hearing in every way.
